Appeals in Austin upheld Austin District Judge 3. Harris Gardner’s ruling that Tennessee Gas Transmission Company is entitled to a $1.1 million tax refund but overruled his additional ruling that the company ‘should get $250,000 interest on the money. The tax was collected under the 1951 gathering tax act declared unconstitutional by the U.S. Supreme Court. Tennessee Gas and several others paid the tax without protest at the time. Atty. Gen. John Ben Shepperd,. opposing a suit seeking to compel admission of two Negro students to Lamar. Tech at Beaumont, argued: “… white students should have some institutions where only white students attend … many , white parents desire to send their children to all-white institutions and should have that choice.” Shepperd filed a brief With the U.S. Supreme Court supporting the right of the states, and not the National Labor Relations Board, to quell disorders involving mass ‘picketing, picketing private homes, or picketing that obstructs state highways. State Auditor C. H. Cavness urged a modern general ware house law to provide “security of storage and reliability of delivery at a reasonable rate.” E. L. DeGolyer, Dallas geologist and art patron, has been appointed to the board-of regents of the Smithsonian Institution. In Sari Antonio, the police are in, sisting.on segregation, at their annual ball, but the county Coliseum o4 :ters have decreed a no-segregation policy for the coliseum. The Texas Railroad Commission permitted the Cotton Belt to discontinue its last two passenger trains, serving Texarkana, Tyler, and Dallas, over protests from East Texans that it would result in economic hardship in the area. The railroad showed it wai losing money on the trains. The old French legation in Austin ‘has become a state shrine. It was bought by the state in 1945 and opened to’ the public last week after restoration work by the Daughters of the Republic of Texas. Judge Jesse Andrews of the firm of Baker, Botts, Andrews, and Shepherd resigned as chairman of the Hou s ton City Planning Commission after .18 years in ‘that position. He was also chairman of the city’s Postwar Planning Committee that recommended -$26 million and $55 million bond improvement programS in. 1944 and 1946, respectively.
